MP SEEKS A 24-YEAR PRISON SENTENCE FOR EFFECTIVE COOPERATOR

Guatemala, August 29, 2012. The Public Prosecutor's Office (MP) requested a prison sentence of 24 years and 9 months for an effective cooperator. The request was made in the summary proceedings, held this morning, against Marlene Raquel Blanco Lapola, former director of the National Civil Police (PNC) and former deputy minister of security. The hearing was held at Court B of the First Instance for High-Risk Matters.

The information offered by the effective cooperator helped to shed light on the murders of Rosa del Carmen Coyoy Ixcot (November, 2009); Lauro Oswaldo Andrino (October, 2009) and Jonhy Estuardo Sac Rojas (June, 2009).

In 2006, the Anti-organized Crime Law established the figure of the effective cooperator—a judicial investigation tool—which makes it possible to resolve cases with the help of testimony given by people involved in a crime and, in a voluntary fashion and depending upon the importance of the information, the person may or may not receive beneficial treatment in their legal proceeding.

In this particular case, the request of the MP sought an incommutable prison sentence of 24 years and 9 months for the accused party, thus reducing the sentence length by two-thirds in accordance with the provisions of the Anti-organized Crime Law.

CICIG acts as a complementary prosecutor in this case.
