LAWYER LINKED TO PROCEEDINGS IN ILLEGAL ADOPTION CASE. JUDGE ORDERS CUSTODY PENDING TRIAL

Guatemala, August 20, 2012. Today, before the judge of the Fourth Court of the First Criminal Instance, an initial appearance was held for the lawyer Raúl Ticún Urías—accused of human trafficking, criminal association and using false documents by the Special Anti-impunity Prosecutor's Bureau of the Public Prosecutor's Office (MP). The accusations concern the lawyer's involvement in the illegal adoption of the child Angely Liseth Hernández Rodríguez.

Ticún Urías, as the SPECIAL JUDICIAL REPRESENTATIVE of US citizens Timothy James Monahan and Jennifer Lyn Vanhorn Monahan, facilitated and fostered the notarial adoption procedure of Angely Liseth Hernández Rodríguez in 2008 (falsely identified as Karen Abigail López García). Furthermore, as the representative, he appeared before the General Directorate of Migration to process the passport of the child so that she could be transported to the United States, where she currently resides.

At the hearing, the Public Prosecutor's Office (MP) enunciated the evidence it had obtained, which demonstrates the involvement of Ticún Urías in promoting and facilitating the recruitment, harboring, reception and transfer of the child Angely Liseth Hernández Rodríguez. The child was subject to an illegal adoption procedure whereby she was handed over to the Monahans. During the illegal adoption procedure, all of the involved parties—despite having knowledge of the negative DNA match between the mother and the child—insisted that the process continue.

The judge of the Fourth Court of the First Criminal Instance ordered that Raúl Ticún Urías be linked to proceedings on the aforementioned charges and remanded in custody due to the risk of flight and the risk of interference with the course of justice.

BACKGROUND FACTS:
The child Angely Hernández was taken on November 3, 2006 from the patio of her house, located in the municipality of San Miguel Petapa in the department of Guatemala City. She was then handed over with false papers to an adoptive family from outside of Guatemala.

CICIG acts as a complementary prosecutor in this criminal proceeding.
