COMMISSION REQUESTS PARTICIPATION IN APPLICATIONS TO LIFT IMMUNITY AGAINST JUDGES

Guatemala, February 6, 2013. The International Commission against Impunity in Guatemala (CICIG) filed complaints before the Judiciary (OJ) this afternoon requesting participation in the applications to lift immunity brought by the Public Prosecutor's Office (MP) against multiple judges. In its Impunity Judges report, presented on November 28, 2012, the Commission accused said judges of malfeasance of office.

CICIG sought participation in the cases of:

  1. José Eduardo Cojulún Sánchez, judge of the Eleventh Court of the First Criminal Instance;
  2. Carlos Aguilar Revolorio, judge of the Second Court of the First Criminal Instance;
  3. Silvia Morales Asencio, judge of the Ninth Court of the First Criminal Instance;
  4. Gerónimo Xitumul, judge of the Fifth Court of the First Criminal Instance (at the time when the malfeasance was committed, Xitumul held the position);
  5. Silvia De León, judge of the Sixth Court of the First Criminal Instance;
  6. Fausto Corado Morán, judge of the Second Chamber of Criminal Appeals;
  7. Artemio Rodulfo Tánchez Mérida, senior judge of the Second Chamber of Criminal Appeals;
  8. Héctor Ricardo Echeverría Méndez, senior judge of the Second Chamber of Criminal Appeals;
  9. Byron Oswaldo De La Cruz López, reserve judge of the Second Chamber of Criminal Appeals.

As part of the petition, CICIG included the decisions of the judges and an analysis of the manner in which they allegedly ruled in breach of the law in cases before them.

The Impunity Judges report refers to the malfeasance of office committed by 18 judges of the Guatemalan justice system through their legal decisions.
