CICIG REPORTS:

Guatemala, 6 June 2014. In response to the documentary "Impunity: Guatemala Report" that was uploaded on YouTube, CICIG hereby states that an investigation has established that the video was the result of a project undertaken by the Commission during the second half of 2012. It is unknown why the documentary was not released at that time or why it was recently uploaded onto the Internet.

CICIG states that at no point did it authorize the publication of the video, neither in 2012 nor in 2014, and has officially requested that the producers remove it. Moreover, the Commission does not share the statements made in the video regarding the link between the Guatemalan private sector and human rights violations and acts of "social cleansing".

In this regard, the Commission reiterates that, as indicated on previous occasions, when an investigation conclusively establishes the criminal responsibility of an individual in a crime, it does everything possible, pursuant to the CICIG mandate, to bring that person to justice. In addition CICIG reaffirms its strong belief that criminal matters should be resolved before courts of law.

The Commission respects the jurisdiction of Switzerland and Spain, where the legal responsibility of certain accused parties is currently being examined in the Pavón case, and also respects the jurisdiction of Guatemala, where an appeal filed by CICIG and the Public Prosecutor's Office (MP) is yet to be ruled on. This appeal challenges the acquittal of other individuals charged under the same case.

CICIG is exploring the possibility of taking legal action in relation to intellectual property rights and copyright.
