Court adds two counts against accused party in Gasofa case

Guatemala, April 19, 2012. Court B of the First Criminal Instance for High-Risk Matters added a count of falsification of license plates and tabs for vehicles and a count of illegal possession of firearms to the charges against Marvin Delfino Barrios Marchena for his alleged participation in the illegal act of smuggling gasoline for more than 10 years (Gasofa case).

The aforementioned counts are added to the charges that led the accused party to be linked to proceedings on January 25, 2012. The charges were of criminal association, customs fraud, interfering with the course of justice, a special case of smuggling, a special case of customs fraud, and money laundering.

The International Commission against Impunity in Guatemala (CICIG) and the Public Prosecutor's Office (MP) asked the Court to add the counts against Barrios Marchena because at the time of the premises search, conducted at the accused party's office, the authorities found firearms, grenades and modified vehicles—as set forth in reports drafted by the National Institute of Guatemala for Forensic Sciences (INACIF) and the General Directorate of Arms and Ammunition Control (DIGECAM).

CICIG acts as a complementary prosecutor in this criminal proceeding and it supports the case investigations.
