SUPREME COURT CONFIRMS SENTENCE IN ROSENBERG CASE
Guatemala, March 31, 2013. At the public hearing held today, the Criminal Chamber of the Supreme Court of Justice ruled the cassation appeals filed by Lucas Josué Santiago López, Edwin Idelmo López, José Armando Ruano Gaitán and Jesús Manuel Cardona Medina to be inadmissible. All of the aforementioned individuals are charged with murder and criminal association in the murder case of the lawyer Rodrigo Rosenberg Marzano.
This decision, therefore, upholds the judgement of October 29, 2010 issued by the First Chamber of the Court of Appeals for Criminal Matters, Drug trafficking and Crimes Against the Environment. In turn, the sentence handed down by the First Trial Court is also upheld, accepting the arguments of the Public Prosecutor's Office (MP) and CICIG—the latter participated in proceedings as a complementary prosecutor.
CICIG participated from the beginning of the investigation, firstly providing technical support and subsequently acting as a complementary prosecutor. This was the first case in which special investigation methods have been used, such as justice collaborators and testimony via videoconference.
